In these terms, we also refer to Japan Scissors as 'our', 'we', or 'us'. And you are you!

Japan Scissors is an Australian company. When you purchase from us:

  • You are importing goods from Australia or Japan into the United Kingdom
  • Orders are dispatched within 1-2 business days
  • Delivery to UK addresses typically takes 3-5 business days via express courier
  • We handle all import duties and VAT — no surprise charges on delivery
  • You are contracting with a non-UK business
  • You retain all UK consumer rights under the Consumer Rights Act 2015

PART A — FOR WHEN YOU BUY PRODUCTS

1. SUBMITTING AN ORDER

(a) By submitting an order for purchase of a Product using the Website's functionality (Order) you represent and warrant that:

  • (i) you have the legal capacity and are of sufficient age (18+) to enter into a binding contract with us; and
  • (ii) you are authorised to use the debit or credit card or payment method you provide with your Order.

(b) Submitting an Order constitutes your offer to enter into these terms where we will provide you with the Products in exchange for payment.

(c) These terms are not agreed until we approve your payment and you receive an email confirming your order is being processed.

(d) We reserve the right to decline any order for any reason, including stock unavailability, pricing errors, suspected fraud, or delivery restrictions.

2. PRODUCTS

(a) Descriptions: We endeavour to ensure Products match Website displays. Due to screen display, colour, brightness, and image quality, Products may not exactly match images.

(b) Specifications: Unless otherwise agreed in writing, we make no guarantees about:

  • (i) the specific material composition (e.g., type of steel or alloy);
  • (ii) the exact manufacturing location beyond what is stated on the product page.

(c) Size: Sizes listed are as specified by manufacturers. You must check sizes before purchasing. You may be liable for shipping fees for size-related exchanges.

(d) Handedness: Unless otherwise clearly specified on the product page, all scissors are right-handed. Left-handed models are clearly marked. Ordering the incorrect handedness does not constitute a product fault.

3. PAYMENT

(a) All prices are:

  • (i) per unit (except where indicated);
  • (ii) displayed in British Pounds Sterling (GBP);
  • (iii) inclusive of UK VAT for orders £135 or less;
  • (iv) subject to change prior to completing an Order.

(b) Payment obligations: Payment is required at time of Order.

(c) Import Duties and VAT: We handle all UK import duties and customs clearance. The price at checkout is the final price — no additional charges on delivery.

(d) Card surcharges: We reserve the right to charge credit card surcharges where permitted by law.

(e) Payment Providers: We use third-party payment providers including PayPal, Stripe, and Clearpay. Their terms and conditions also apply to your transaction.

(f) Pricing errors: If we discover pricing errors after you place an order, we'll contact you to reconfirm at the correct price or cancel with a full refund.

4. CHANGES TO YOUR ORDER

4.1 CANCELLATION BY US

We reserve the right to cancel your Order for any reason with full refund, including stock unavailability or suspected fraudulent activity.

4.2 CANCELLATION BY YOU

You may cancel until we confirm your Order has been dispatched. Once dispatched, use your 14-day withdrawal right below.

4.3 YOUR 14-DAY WITHDRAWAL RIGHT

Under the Consumer Contracts Regulations 2013, you have 14 days to withdraw from this contract without giving any reason.

To exercise your right:

  • Contact us within 14 days of receiving the goods
  • Email: support@japanscissors.co.uk
  • We'll provide return instructions
  • Return the goods at your cost
  • Goods must be unused, in original condition and packaging

Refund timeline: Within 14 days of receiving returned goods.

Deductions: A 10% restocking fee applies to change-of-mind returns to cover inspection and repackaging costs.

4.4 FAULTY PRODUCTS — YOUR STATUTORY RIGHTS

Under the Consumer Rights Act 2015:

  • Within 30 days: Full refund if faulty
  • After 30 days: Repair or replacement first, then refund if unsuccessful
  • Up to 6 years: Claims possible for manufacturing defects

Process for faulty products:

  1. Email us at support@japanscissors.co.uk with description and images of the fault
  2. We may request return for inspection (at our cost if fault confirmed)
  3. If fault confirmed: repair, replacement, or refund at your choice

4.5 WHAT IS NOT A FAULT

The following are not considered faults entitling you to a remedy:

  • Normal wear and tear from use, including blade dulling through normal cutting
  • Damage caused by misuse, accidents, drops, or improper technique
  • Damage from incorrect maintenance, adjustment, or third-party sharpening
  • Chemical damage from hair products, sanitisers, or cleaning agents
  • Rust or corrosion caused by failure to dry and oil scissors after use
  • Ordering the wrong size, style, or handedness (this is change of mind)

4.6 EXCLUSIONS FROM RETURNS

Returns are not accepted for:

  • Used products (unless faulty)
  • Products not in original condition with all packaging and accessories
  • Custom or personalised items
  • Items returned after the 14-day withdrawal period (unless faulty)

Note: Shipping insurance fees are non-refundable once shipped, including Route Shipping Protection.

5. INTELLECTUAL PROPERTY

(a) We retain all intellectual property rights in Product designs, labelling, and packaging.

(b) You must not copy, reproduce, manufacture or commercialise our Products or branding.

6. THIRD PARTY SUPPLIERS

(a) We may outsource services or procure from third parties without notice.

(b) To the maximum extent permitted by law, we're not liable for third party acts or omissions beyond our reasonable control.

7. DISCOUNT CODES

Discount Codes:

  • Cannot be applied retrospectively to completed orders
  • Are non-transferrable and single-use unless stated otherwise
  • Cannot be redeemed for cash
  • May have minimum spend requirements, product exclusions, or expiry dates
  • Cannot be combined with other offers unless expressly stated

8. RATINGS & REVIEWS

(a) Reviews must be true, fair and accurate.

(b) You may only review Products you've purchased.

(c) We reserve the right to remove any review that is false, misleading, defamatory, or off-topic.

PART B — FOR WHEN YOU BROWSE THIS WEBSITE

9. ACCESS AND USE OF THE WEBSITE

You must only use the Website in accordance with these terms and all applicable laws.

10. YOUR OBLIGATIONS

You must not:

  • (a) copy, reproduce, or modify any part of the Website without our written consent;

  • (c) use the Website for illegal or fraudulent activity;
  • (d) interfere with or disrupt the Website or servers;

(a) You may register for an Account to facilitate purchases.

(b) You must provide accurate, current information and keep it updated.

(c) You're responsible for:

  • maintaining Account security and password confidentiality;
  • all activities that occur through your Account.

(d) Notify us immediately of any unusual activity or security breach.

(e) We may suspend or cancel Accounts at our discretion if we suspect misuse or breach of these terms.

We don't guarantee that:

  • the Website will be error-free or uninterrupted;
  • the Website will be accessible at all times;
  • all information is accurate, complete, or current.

We reserve the right to change information without notice.

13. INTELLECTUAL PROPERTY

(a) We retain ownership of all Website Content including text, images, graphics, logos, and software.

PART C — DELIVERY, RISK OF LOSS, AND YOUR RESPONSIBILITIES

18. SHIPPING AND DELIVERY

18.1 WHERE WE SHIP FROM

Your order will be dispatched from one of the following locations:

  • Brisbane, Australia — Our main distribution centre for most products
  • Saitama, Japan — Select Japanese brands shipped direct from manufacturer

You acknowledge and accept that by placing an order, you are importing goods into the United Kingdom from Australia or Japan.

18.2 DELIVERY COSTS AND TIMEFRAMES

  • Free delivery on all scissors and orders over £47
  • £10 delivery charge on accessory orders under £47
  • Processing time: 1-2 business days
  • Express delivery: 3-5 business days to most UK addresses

Delivery times are estimates only and are not guaranteed. We are not liable for delays beyond our reasonable control, including customs processing, carrier delays, weather events, or public holidays.

18.3 CARRIERS

We use reputable international express carriers including FedEx International Priority and DHL Express. The carrier is selected at our discretion based on availability and your delivery location.

18.4 DELIVERY ADDRESS

You are responsible for providing a complete and accurate delivery address at checkout. We are not responsible for:

  • Delays or non-delivery caused by incorrect or incomplete address information
  • Parcels delivered to the wrong location due to address errors you provided
  • Additional costs for redelivery or address corrections after dispatch

We cannot redirect parcels once they have been dispatched. Please double-check your address before completing your order.

18.5 CUSTOMS AND IMPORT DUTIES

We handle UK customs clearance, import duties, and VAT on your behalf. The price you pay at checkout is the final price — you will not receive any additional charges on delivery.

19. RISK OF LOSS AND TRANSFER OF RESPONSIBILITY

19.1 WHEN RISK PASSES TO YOU

Risk of loss or damage to the Products passes to you upon delivery.

"Delivery" occurs when:

  • (a) The carrier delivers the parcel to your specified delivery address and obtains a signature; or
  • (b) The carrier delivers the parcel to your specified delivery address and leaves it in accordance with delivery instructions you have provided (including "Authority to Leave", "Safe Place", or "Leave with Neighbour" instructions); or
  • (c) The carrier leaves the parcel at your delivery address in accordance with any standing delivery preferences you have registered with the carrier (such as FedEx Delivery Manager or similar services); or
  • (d) The parcel is available for collection at a carrier depot, collection point, or post office following an attempted delivery.

19.2 AUTHORITY TO LEAVE AND SAFE PLACE DELIVERIES

If you or the carrier have enabled "Authority to Leave", "Safe Place", "Signature Release", or similar delivery preferences:

  • You authorise the carrier to leave parcels at your address without obtaining a signature
  • Risk of loss, theft, or damage passes to you once the parcel is left at your premises
  • We are not liable for parcels that are stolen, damaged, or go missing after the carrier has delivered them to your address
  • You accept responsibility for ensuring your delivery location is secure

We strongly recommend:

  • Disabling "Authority to Leave" preferences for valuable orders
  • Providing delivery instructions for a secure location not visible from the street
  • Having parcels delivered to your workplace or a trusted neighbour if you won't be home
  • Using carrier collection points or parcel lockers for added security

19.3 THEFT OR LOSS AFTER DELIVERY

Once a parcel has been delivered to your address, we are not responsible for:

  • Theft of the parcel from your property ("porch piracy")
  • Loss or disappearance of the parcel after delivery
  • Damage occurring after delivery
  • Parcels taken by other persons at your address without your knowledge

If tracking confirms delivery to your address (including photographic proof of delivery and/or GPS confirmation), and you subsequently claim the parcel is missing, this constitutes a theft from your property — not a failure of delivery by us.

In such circumstances:

  • We will cooperate with carrier investigations
  • You should file a police report for the stolen property
  • You may have recourse through your home or contents insurance
  • We are not obligated to provide a refund or replacement for parcels confirmed as delivered

19.4 SIGNATURE CONFIRMATION

For high-value orders, we may require signature confirmation at our discretion. Where signature confirmation is used:

  • The carrier will only release the parcel upon obtaining a signature
  • If you are not available, the carrier will leave a collection notice
  • You must collect the parcel within the carrier's specified timeframe or arrange redelivery

19.5 PROOF OF DELIVERY

Our carriers provide proof of delivery which may include:

  • Tracking confirmation showing "Delivered" status
  • Date and time of delivery
  • GPS coordinates of the delivery scan
  • Photographic evidence of the parcel at your address
  • Signature (where applicable)
  • Name of person who signed (where applicable)

This proof of delivery constitutes evidence that we have fulfilled our delivery obligations.

19.6 DISPUTED DELIVERIES

If you claim non-receipt of a parcel that tracking shows as delivered:

  • We will open an investigation with the carrier
  • We may request you provide a statutory declaration or police report
  • We will review GPS data and photographic proof of delivery
  • If the carrier confirms delivery to the correct address, we are not obligated to provide a refund or replacement

Making false claims of non-receipt may constitute fraud and may be reported to relevant authorities.

20. DELIVERY ISSUES

20.1 GENUINELY LOST OR MISSING PARCELS

If your parcel is genuinely lost in transit (tracking does not show delivery, or tracking has not updated for an extended period):

  • Contact us at support@japanscissors.co.uk
  • We will investigate with the carrier
  • If the parcel is confirmed lost, we will provide a replacement or refund at our discretion

20.2 DAMAGED IN TRANSIT

If your parcel arrives damaged:

  • Take photographs of the packaging and contents immediately
  • If possible, refuse delivery for obviously damaged parcels
  • Contact us within 48 hours with photos and description
  • We will arrange a replacement or refund

20.3 MISDELIVERED PARCELS

If carrier GPS data or photographic proof shows the parcel was delivered to an incorrect address (not the address you provided):

  • We will work with the carrier to attempt retrieval
  • If retrieval is unsuccessful, we will provide a replacement or refund

20.4 REFUSED DELIVERY

If you refuse delivery without valid reason, or fail to collect a parcel from a depot within the required timeframe, causing it to be returned to us:

  • You may be charged return shipping costs
  • Refunds will be reduced by shipping costs incurred

21. SHIPPING INSURANCE

We may offer optional shipping insurance through Route or similar services at checkout.

If you purchase shipping insurance:

  • You enter into a separate agreement with the shipping insurance provider
  • Claims for lost, stolen, or damaged items must be made directly with that provider
  • We will assist with claims where possible but do not guarantee outcomes
  • Shipping insurance fees are non-refundable once shipping has commenced

If you decline shipping insurance, you accept the risk allocation set out in these terms.

PART D — LIABILITY AND OTHER LEGAL TERMS

22. LIABILITY

(a) UK Consumer Rights: Nothing in these terms limits your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation.

(b) Our liability: We do not exclude or limit liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession);
  • breach of the terms implied by sections 13-15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose);
  • defective products under the Consumer Protection Act 1987;
  • any liability that cannot be excluded or limited by law.

(c) Limitations: Subject to the above, our total liability to you for any claim arising from or related to these terms is limited to the greater of:

  • the total fees paid by you in the 12 months before the claim; or
  • £100.

(d) Exclusions: Subject to paragraph (b), we are not liable for:

  • loss of profits, business, revenue, or anticipated savings;
  • loss of data or information;
  • indirect, special, or consequential losses;
  • losses arising from theft of delivered parcels from your property;
  • losses arising from your failure to secure your delivery location;
  • losses arising from "Authority to Leave" or similar delivery preferences you have enabled.

(e) Indemnity: You agree to indemnify us against claims arising from your:

  • breach of these terms;
  • misuse of the Website;
  • misuse of Products;
  • provision of false information, including false claims of non-receipt.

23. FORCE MAJEURE

Neither party is liable for failure or delay in performing obligations due to circumstances beyond reasonable control, including:

  • acts of God, natural disasters, severe weather;
  • war, terrorism, civil unrest, strikes;
  • government actions, customs delays, regulatory changes;
  • pandemic or epidemic;
  • postal or courier service disruptions;
  • power failures, telecommunications outages, cyberattacks;
  • supplier failures or material shortages.

24. NOTICES

Notices must be in writing via email:

  • To us: support@japanscissors.co.uk
  • To you: your registered email address or the email provided with your order

Notice is deemed given 24 hours after sending unless a bounce-back is received.

25. GENERAL PROVISIONS

25.1 GOVERNING LAW AND JURISDICTION

These terms are governed by the laws of Western Australia. However, UK consumers retain all protections under UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Disputes may be brought in UK or Australian courts at your election.

25.2 DISPUTE RESOLUTION

If you have a complaint, please contact us first at support@japanscissors.co.uk. We are committed to resolving issues promptly and fairly.

UK consumers may also use:

25.3 WAIVER

No waiver of any right under these terms is effective unless in writing and signed. A waiver applies only to the specific circumstances for which it is given.

25.4 SEVERANCE

If any provision of these terms is found invalid or unenforceable, that provision will be severed and the remainder will continue in full force and effect.

25.5 ASSIGNMENT

You cannot assign your rights under these terms without our written consent. We may assign our rights to a successor in connection with a merger, acquisition, or sale of our business.

25.6 ENTIRE AGREEMENT

These terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between us regarding your purchase and use of our Website.
